I'm pretty sure iStock's photos are watermarked, are they not?
And you're still making a derivative work from something that isn't yours, so no, it wouldn't be legal. Granted, using any stock you don't have permission for is copyright infringement.
It would be a bit easier to judge this one if you posted up the picture, and where you got it.
well it should say somewhere on the website whether or not you do actually have permission to use that one.
And as for the "using it as a guide" theory, any derivative works created from copyright material you don't have permission to use is still copyright infringement.
