Yep, yep and that's all reason to rate something at a terrible level. The text isn't distracting at all, it's blended in the BG properly. Yes the smudging is very trivial, but by no means doesn't it look terrible. I've never on any forum seen anyone give someone that low of a rating, even the WORST tag I've ever seen... Not distracting in the sense that it's not blended well, it's distracting in the sense that it's not anywhere near your focal, at all.
